AUCTION REGISTRATION:  In order register for this auction click the “Click for Online Bidding” Tab. At the top of the page click “Register to Bid”.  Once you submit your information, you will receive an email with your bidder number and your will use the password you created.  An auction representative will be in contact to confirm an understanding of the terms and conditions.  

CREDIT CARD VALIDATION: To identify our bidders, participation in this auction requires a One Dollar ($1.00) authorization hold by a major Credit Card prior to bidding. This $1.00 is NOT CHARGED, it is merely an authorization held by your financial institution, although it may appear as a pending transaction on your account.  It is released at the conclusion of the auction.   

BUYER’S PREMIUM:   10% Buyers Premium will be added to the high bid to determine the final selling price of the property.  Example: For a winning bid of $100,000, a 10% buyer’s premium of $10,000 will be added making the final purchase price $110,000.

TERMS:  The winning bidder will  submit a ten percent (10%) non-refundable earnest money deposit of the purchase price by certified funds or wire transfer made payable to Charles Gay Realty and Auction Escrow Account with the balance due within 30 days at closing.  Immediately following the auction, the winning bidder will be required to sign an “as-is” Auction Real Estate Sales Contract and the 10% non-refundable earnest money must be received within 24 hours. 

WARRANTY AND CONDITION: Property being sold in “as-is” condition with all faults, without warranty of any kind, except for marketable title, and is selling  subject to all easements, restrictions, zoning, covenants,  conditions and all  other matters contained in public record or revealed by a survey.  Personal onsite inspection is strongly recommended.  Bidders shall rely on their own inspection, and not upon any description by the auctioneer, seller or their respective agents.    

PROPERTY INSPECTION:  We will have a auction representative onsite Wednesday, June 1st at  11:00 A.M. 

 FINANCING: Sell is NOT contingent of Buyer’s ability to obtain financing. Because financing is NOT a contingency, all Bidder’s must make certain in advance they are capable of obtaining any financing  necessary to close the transaction.   

CLOSING:  Closing will be conducted at the Buyer’s Designated Closing Attorney and must occur on or before 30 days following the auction unless extended in writing by mutual consent of the parties. It is the Buyer’s responsibility to schedule the closing. Failure to schedule the closing does not relieve the purchaser of obligation to close or forfeit earnest money. 

CLOSING COST:  Buyer is responsible for all cost associated with the closing including but not limited to surveys, title examination, transfer tax, deed preparation, recording fees and loan closing cost.  Seller is responsible for his / her share of prorate property tax.  Sale is contingent upon Purchaser’s ability to obtain insurable title.

BROKER PARTICIPATION WELCOME: A broker commission of twenty (20%) of the Auctioneers Commission will be paid.  In most instances this will equate to two (2%) of the bid price.  However, on some transactions, total commissions paid may be smaller than the ten (10%) of the bid price.   To qualify for a commission Broker must register by fax (888) 316-3852, mail, hand delivery or email Robinhuff@atlbid.com using the Broker Registration Form found under the Documents Tab within 48 hours of scheduled auction.  Broker must abide by rules listed on Broker Registration Form.
